    Still, this is clearly interstate commerce, and could be regulated by congress as such "the United States Congress shall have power "To regulate Commerce with foreign Nations, and among the several States" (from the constitution). That being said, the Executive Branch can't just decree said regulation from on high, it would have to be a bill passed through congress.
