I have more than 25 years of crash scene investigation, working with NHTSA and Product Liability lawyers. EDRs were mandated by NHTSA to aid in reconstruction of severe incidents to aid in improving Fed safety standards. The use of the data is a two-edged sword. It can be used to assist the car maker by showing driver error, or it can assist the trial lawyer to establish that a defect existed. The third, silly issue is whether the car owner can access the data. Why? It is too technical for the layman.

Majority of the Toyota claims are bogus anyways. And I know this story is not related to it, but I think that it's stupid they're putting "noise maker's" on the Prius so people can hear it coming.... Only in America!
